Terms of Service

1. Acceptance of Terms
By accessing or using Spellcast (“the Service”), operated by Samantha Kellow (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Spellcast is a social media scheduling and management tool that allows you to connect social media accounts and schedule content for publication. The Service integrates with third-party social media platforms via their official APIs, including TikTok, Instagram, Facebook, X/Twitter, LinkedIn, Threads, and Bluesky.
3. Eligibility
You must be at least 13 years old to use Spellcast. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
4. Your Account
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at privacy@sammii.dev if you suspect unauthorised access to your account.
- We reserve the right to suspend or terminate accounts that violate these terms.
5. Connected Social Accounts
When you connect a social media account to Spellcast, you authorise us to access and use that account's API on your behalf, subject to the permissions you grant via OAuth. You agree that:
- You own or have the right to publish the content you schedule through Spellcast.
- You will comply with the terms of service of each connected platform (TikTok, Meta, X, LinkedIn, etc.).
- You will not use Spellcast to publish content that violates any platform's community guidelines or terms of service.
- You can disconnect any social account at any time from within Spellcast settings.
6. Acceptable Use
You agree not to use Spellcast to:
- Publish spam, misleading content, or content that violates any applicable law.
- Infringe any intellectual property, privacy, or other rights of third parties.
- Attempt to gain unauthorised access to any system, account, or data.
- Interfere with or disrupt the Service or its infrastructure.
- Use the Service for any unlawful purpose.
7. Content Responsibility
You are solely responsible for all content you create, schedule, or publish using Spellcast. We do not review content before publication and are not liable for any content you publish. You retain all intellectual property rights in your content.
8. Third-Party Platform Terms
Your use of connected social media platforms is governed by each platform's own terms of service. You are responsible for complying with those terms. We are not affiliated with, endorsed by, or responsible for any third-party platform.
If a platform API changes, becomes unavailable, or revokes access, we will make reasonable efforts to restore functionality but cannot guarantee uninterrupted service.
9. Intellectual Property
The Spellcast application, including its design, code, and branding, is owned by Samantha Kellow. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without prior written permission.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that scheduled posts will publish successfully. Platform API changes, outages, or rate limits may affect delivery.
11. Limitation of Liability
To the fullest extent permitted by law, Samantha Kellow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service or the publication (or failure to publish) of any content.
12. Indemnification
You agree to indemnify and hold harmless Samantha Kellow from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may close your account at any time by contacting us at privacy@sammii.dev.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
